By accessing and using our website, booking our services, or purchasing travel-related products from us, you agree to abide by the following Terms and Conditions (“Terms”). These Terms constitute a binding legal agreement between you (“the Client”, “you”, or “your”) and Travel by Dezign (“the Agency”, “us”, “we”, or “our”). Please read these Terms carefully before using our services. If you do not agree with any aspect of these Terms, you should refrain from using our services.

• “Services” refers to all travel-related services provided by Travel by Dezign, including but not limited to flight bookings, hotel reservations, package tours, car rentals, and travel consultations.
• “Supplier” refers to airlines, hotels, cruise lines, car rental companies, tour operators, and other third-party service providers whose products and services are made available through Travel by Dezign.
• “Booking” means any reservation or purchase of travel services made via Travel by Dezign’s website, phone, email, or in person.

You must be at least 18 years old and have the legal capacity to enter into binding agreements in order to use our Services. By making a Booking, you confirm that you meet these requirements.

• Travel by Dezign charges a non-refundable planning fee ranging from $100 to $200 for each trip. The exact amount will be communicated during your initial consultation and must be paid before detailed planning or proposals are provided.
• All Bookings are subject to availability and confirmation by the relevant Supplier.
• Prices quoted are subject to change until the Booking is confirmed and paid in full.
• To confirm your Booking, a deposit or full payment may be required, depending on the Supplier’s policies. Payment deadlines will be communicated at the time of Booking.
• Payment can be made via methods accepted by Travel by Dezign (credit cards, bank transfer, etc.). Payment details and any applicable fees will be provided during the Booking process.
• Failure to make timely payment may result in cancellation of the Booking and loss of any deposit paid.

• Chargeback Waiver and Dispute Resolution:
• You agree not to initiate, and you waive any right to pursue, any credit- or debit-card chargeback, reverse-charge, refund, or recollection (collectively, “Chargeback”) for any reason including delay, cancellation, refusal of entry, exit, or transit, force majeure event, provision or non-provision of Travel Services, Supplier price changes, fees, or penalties, Food Allergies or any other matter relating to your Trip, except in the case of fraud.
• Even in the case of fraud, before initiating any Chargeback, you agree to first address the matter directly with us in writing to give us a reasonable time to investigate the matter and respond to you.
• If you initiate a Chargeback relating to any amount we validly charge to your Card without our prior written authorization, you agree to pay us for all fees and costs, including attorney’s fees and legal expenses, we incur to dispute and respond to that Chargeback.
• If you initiate a charge back or payment dispute with your credit card provider or financial institution for a travel service or fee that was validly provided by Travel by Dezign, you remain responsible for the full amount due. You agree to reimburse Travel by Dezign for any expenses, fees, or losses incurred as a result of the charge back, including but not limited to merchant processing fees, legal expenses, and collection costs.
• Travel by Dezign reserves the right to dispute any charge back or payment reversal and provide all relevant documentation to your financial institution to demonstrate the validity of the transaction.
• Future services may be refused or bookings cancelled if outstanding charge backs or disputes are not resolved promptly.
• This section will survive termination of these Terms.

• Requests for changes or cancellations must be submitted in writing and are subject to the terms and conditions of the relevant Supplier(s).
• Travel by Dezign charges a service fee for processing changes or cancellations, in addition to any fees imposed by Suppliers.
• If a trip is cancelled, a $100 cancellation fee will be charged per entire booking (not per person), regardless of the number of travelers. This fee is in addition to any Supplier-imposed cancellation fees and is non-refundable.
• Refunds, if applicable, will be processed according to Supplier policies and may be subject to deductions for service fees and non-refundable amounts.
• Some Bookings may be non-refundable or non-changeable. You will be notified of such conditions at the time of Booking.

• All prices are quoted in the currency specified at the time of Booking and are subject to change without notice until the Booking is confirmed.
• Unless otherwise stated, prices include only the components explicitly listed in your Booking confirmation (such as accommodation, flights, transport, etc.).
• Excluded items may include, but are not limited to, travel insurance, visas, personal expenses, meals not specified in the itinerary, and optional excursions.
• Travel by Dezign is not responsible for price increases or changes related to currency fluctuations, government taxes, airline surcharges, or other factors beyond our control.

• You are solely responsible for ensuring that you have valid passports, visas, permits, and any other documents required for your travel itinerary. Acceptable identification can be found at http://www.tsa.gov/ and examples include DHS-designated enhanced driver’s license, US passport, or a foreign government passport.
• Travel by Dezign will provide general information on passport and visa requirements, but it is your responsibility to verify and obtain the necessary documentation prior to travel.
• Entry to a country or region is at the sole discretion of border authorities. Travel by Dezign is not liable for denied entry or any resulting costs or losses. Please be advised that some countries will not allow passengers to enter the country if their passport expires within 6 (six) months of expiration.
• Children and infants may also require travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities; please see https://help.cbp.gov for additional information. The U.S. Customs and Border Protection Agency requires that for groups of children under age 19 arriving to the United States by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult or group leader in writing.
• The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on your tickets and booking records. You acknowledge that it is your responsibility to ensure that the information on your tickets and confirmations is accurate. Any discrepancy between your reservation and your travel documentation may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss your flight, and any subsequent scheduled travel bookings on cruises and tours.
• You must have the proper immunizations and health screenings and required documentation of such immunizations and screenings before travel. Travel by Dezign shall not assume responsibility for the accuracy of health, vaccination, or documentation requirements prior to departure or upon landing at the final destination. In some cases, required inoculations must be recorded by Client’s health practitioner on a valid vaccination certificate, which the Client must carry for proof of inoculation. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the State Department Web site http://travel.state.gov, for relevant information relating to travel to specific destinations, and the Center for Disease Control http://wwwnc.cdc.gov/travel/ relating to health issues related to travel.
• WHEN YOU RECEIVE ANY AND ALL TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT TRAVEL BY DEZIGN IMMEDIATELY IF CHANGES OR CORRECTIONS ARE REQUIRED.

• We strongly recommend that all Clients purchase comprehensive travel insurance to cover health, cancellation, delays, lost baggage, and other unforeseen circumstances.
• It is your responsibility to ensure your insurance policy is adequate for your needs and to understand the coverage limits and exclusions.

• Travel by Dezign acts as an agent for Suppliers, and does not own or operate the services or products provided by Suppliers.
• We are not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any Supplier or for any personal injuries, death, property damage, or other damages resulting therefrom.
• We are not liable for delays, cancellations, overbookings, strikes, force majeure, or other events beyond our direct control.
• Travel by Dezign’s total liability for any claim relating to Services supplied under these Terms is limited to the amount paid by you for the specific Booking in question.

Travel by Dezign is not liable for any failure or delay in performance of its obligations as a result of events beyond its reasonable control, including but not limited to act of God, natural disasters, war, terrorism, strikes, government restrictions, epidemics, or failure of suppliers

• You must inform Travel by Dezign at the time of Booking of any medical conditions, mobility issues, dietary requirements, or other special needs that may affect your travel.
• We will do our best to accommodate reasonable requests, but cannot guarantee that all services or facilities will be accessible or available.
• Clients assume all risks associated with travel, including but not limited to personal injury, illness, property loss, and unforeseen events.

• All Clients are expected to conduct themselves in a respectful and lawful manner while traveling.
• Travel by Dezign and its Suppliers reserve the right to refuse service or remove any Client whose behavior is deemed disruptive, dangerous, or in violation of local laws or customs.
• No refund or compensation will be provided in such cases.

• If you have a complaint about any aspect of your trip, you must notify us and the relevant Supplier as soon as possible so that we can attempt to resolve the issue on-site.
• If the complaint is not resolved to your satisfaction, you must submit a written complaint to Travel by Dezign within 30 days of your return.
• We will investigate and respond to your complaint in a timely manner. If a dispute remains, both parties agree to attempt to resolve the matter through negotiation or mediation before pursuing legal remedies.

All content on Travel by Dezign’s website, brochures, and promotional materials—including text, images, logos, and trademarks—is the exclusive property of Travel by Dezign and may not be used, reproduced, or distributed without our prior written consent.

• Your privacy is important to us. We collect, use, and protect personal information in accordance with our Privacy Policy, which is available on our website or upon request.
• By using our Services, you consent to our collection and use of your information as described in our Privacy Policy.

Travel by Dezign reserves the right to update or modify these Terms at any time without prior notice. The most current version will be posted on our website. Continuing to use our Services after changes have been made constitutes your acceptance of the revised Terms.

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Travel by Dezign is registered. All disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

These Terms and Conditions, together with any Booking confirmation and other written communications from Travel by Dezign, constitute the entire agreement between you and the Agency and supersede any prior agreements or understandings.
